1. ClinicalWill.app Ltd (trading as ClinicalWill.app), incorporated and registered in England and Wales with company number 14131785, whose registered office is at Amelia House, Crescent Road, Worthing, BN11 1RL (ClinicalWill.app) operates a referral reward offer open to platform users who meet the criteria set out below (the Referral Offer).
2. ClinicalWill.app may from time to time provide an Amazon eGift card with a balance of £20 (the Gift Card) to the referring party (the Referring Practitioner) in respect of each Prospective Customer who the Referring Practitioner refers to ClinicalWill.app, and who signs up to a paid for subscription for access to the ClinicalWill.app platform in accordance with these terms and conditions (the Terms).
3. The Referral Offer shall be available from 29 March 2025 until it is suspended or cancelled by ClinicalWill.app, which ClinicalWill.app may do at any time at its sole discretion.
4. The Referring Practitioner who wishes to participate in the Referral Offer by referring a new Prospective Customer who satisfies the conditions set out below in clause 6 (a Prospective Customer) should provide their unique referral link (the Unique Link) to the Prospective Customer for use by the Prospective Customer in registering for access to the ClinicalWill.app platform. There is no limit on the number of referrals which the Referring Practitioner may make.
5. The Referring Practitioner must:
5.1. be 18 years old or over;
5.2. be an existing user of ClinicalWill.app with a current annual subscription;
5.3. remain an existing user of ClinicalWill.app with a current annual subscription, and remain in full compliance with the terms of the Subscriber Agreement and the Data Processing Agreement until the Gift Card has been dispatched; and
5.4. not be a resident of the USA or Canada.
6. A qualifying Prospective Customer must:
6.1. be 18 years old or over;
6.2. have given consent to the Referring Practitioner to receive the Unique Link from the Referring Practitioner;
6.3. use the Unique Link sent to them by the Referring Practitioner to sign up for an annual subscription by completing the full registration process for access to the ClinicalWill.app platform;
6.4. not, at the point of sign-up, be a current or past user of the ClinicalWill.app platform under an annual or free trial subscription;
6.5. pay an initial annual subscription fee of at least £40;
6.6. remain a user of ClinicalWill.app with a current annual subscription for a minimum of 45 days;
6.7. not be a resident of the USA or Canada.
7. ClinicalWill.app accepts no responsibility for offer entries not successfully completed or submitted due to a technical fault (such as a technical malfunction, computer hardware or software failure, satellite, network or server failure, or any issue with the Unique Link) of any kind.
8. Where the Referring Practitioner is entitled to a Gift Card under these Terms, the Gift Card will be emailed to the Referring Practitioner using the email address registered to the Referring Practitioner's existing current subscription to ClinicalWill.app within six weeks of the conditions contained in these Terms being met. ClinicalWill.app is not responsible for Gift Cards not received due to a technical fault beyond the control of ClinicalWill.app.
9. The Referring Practitioner acknowledges and agrees that ClinicalWill.app may send further communications to them in relation to the Referral Offer and may be required to share their contact details with third-party service providers (such as payment gateway providers) and Amazon EU SARL, for specific purposes related to the Referral Offer.
10. A Gift Card may be redeemed on the www.amazon.co.uk website towards the purchase of eligible products available online. Gift Cards cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account. Neither ClinicalWill.app nor Amazon are responsible if a Gift Card is lost, stolen, destroyed or used without permission. The use of the Gift Card is subject to Amazon's terms and conditions which can be found here.
11. Amazon.co.uk and Amazon EU SARL are not sponsors of this promotion.
12. ClinicalWill.app retains the right to substitute the Gift Card with another reward of similar value.
13. The Gift Card is not negotiable or transferable through ClinicalWill.app for any other product or service or a cash alternative.
14. If there is any reason to believe that there has been a breach of these terms and conditions or if ClinicalWill.app suspects any fraudulent activity has taken place in relation to the Prospective Customer, ClinicalWill.app reserves the right to refuse to issue a Gift Card or exclude parties from participating in the Referral Offer.
15. Any applicable taxes arising from the receipt of the Gift Card are the sole responsibility of the Referring Practitioner and neither ClinicalWill.app nor its affiliates shall be responsible in any manner for advising participants on any tax obligations.
16. ClinicalWill.app reserves the right to issue any documentation, such as receipts or statements, confirming supply of the Gift Card which may be required by law to support its tax obligations.
17. The Referring Practitioner acknowledges that ClinicalWill.app does not, as part of its operations in providing the Referral Offer, collect personal data for its own purposes and that any data collected as a result of participation in the Referral Offer is stored securely and confidentially by ClinicalWill.app. However, ClinicalWill.app shall, in providing the Referral Offer comply with its legal and statutory obligations relating to the privacy and security of any personal data as laid out in our Privacy Notice.
18. These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
19. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter (including non-contractual disputes or claims).
